Comprehensive Zoning By-law Appeals - Ontario Land Tribunal Update - 2026-35

 

Section 239(2)(e) and (f) of the Municipal Act, regarding litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board and advice that is subject to solicitor-client privilege, including communications necessary for that purpose.

The following resolutions have been prepared to facilitate Council’s consideration of various matters and are suggested for consideration. If Council wishes to address a specific report in isolation of the Consent Agenda, please identify the item. It will be extracted and dealt with separately as part of the Items for Discussion.

  • Recommendation:
    1. That the City Clerk be authorized to publish and serve notice of intention to designate 38 Clinton Street pursuant to Part IV, Section 29 of the Ontario Heritage Act.
    2. That the designation bylaw be brought before Council for approval if no objections are received within the thirty (30) day objection period.
  • Recommendation:
    1. That the City Clerk be authorized to publish and serve notice of intention to designate 44 Edinburgh Road North pursuant to Part IV, Section 29 of the Ontario Heritage Act.
    2. That the Heritage Advisory Committee advises City Council that the committee supports the heritage attributes recommended in the staff report titled “44 Edinburgh Road North – Draft Council Designation Report” and dated January 15, 2026.

The following items have been extracted from the Committee of the Whole Consent Report and the Council Consent Agenda and will be considered separately. These items have been extracted either at the request of a member of Council or because they include a presentation and/or delegations.

  • Recommendation:
    1. That the City-initiated Official Plan Amendment Number 110 to update the Official Plan be approved in accordance with Attachment-1 of Report 2026-40, dated February 10, 2026.

  • Recommendation:
    1. That staff be directed to report back with process considerations regarding a potential site-specific, council-initiated land use amendments for the 8 hectare parcel of land with the legal description of PT LT 13 CON 5 Puslinch PT 1, 61R1483.

  • Recommendation:
    1. That City Council, in accordance with Section 41 of the Ontario Heritage Act, designate by by-law the area shown in Attachment-1 of this report, as the Ontario Reformatory Heritage Conservation District.
    2. That City Council adopt by by-law the Ontario Reformatory Heritage Conservation District Plan and Guidelines (Attachment-2) as the district plan for the Ontario Reformatory Heritage Conservation District.
